By making a booking at the Last Light Lodge, you agree to these Terms and Conditions.
Please read these Terms and Conditions carefully.
1 DEFINITIONS
1.1 Peak Season – the following periods in each calendar year:
• 21 December – 10 January
• Easter (Good Friday, Easter Saturday, Easter Sunday and Easter Monday)
• All other statutory holidays observed in New Zealand
• Southland Anniversary Day
1.2 The Property – any property located at 2,4,6 Clifden Highway Tuatapere.
1.3 Us, we, our – Rutland Crest Limited and Last Light Lodge (trading name).
1.4 You – all future, current or past guests of the Last Light Lodge and agents booking on behalf of guests.
2 RATES & INCLUSIONS
2.1 Rates include 15% GST (if any).
2.2 Rates are quoted in New Zealand dollars ($NZD).
2.3 Rates are charged on a per night basis per guest.
2.4 Rates are subject to confirmation at the time of reservation and subject to all payments being paid by due dates.
2.5 Child policy:
• Children aged up to 24 months old are free of charge.
• Children aged over 24 months and up to 12 years old are considered half rate paying guests for the camping bookings, full rate for the rooms.
• Children aged over 12 years old are considered full rate paying guests.
2.6 Check-in is from 3pm to 8pm and check-out is at 10am. Other times by arrangement.
2.7 Inclusions: the following are included in each guest stay:
• WiFi access, but we can’t guarantee the speed and availability at all times being only an ADSL.
• Use of lodge facilities : kitchen, dining-lounge areas, laundries, bathrooms
2.8 Smoking is strictly prohibited in the rooms and facilities. A $250 fee will apply to any smoking inside the buildings. Smoking Outdoor is allowed but must be respectful of others and the grounds.
3 RESERVATION & CANCELLATION POLICY
3.1 Booking confirmation: to secure a booking we must receive a confirmed reservation email with a full payment or 50% deposit, and we held your debit or credit card details as security for any damages, loss (keys), smoking inside or excessive cleaning.
3.2 Final payment for groups: final payment is required on arrival, except at Peak Season dates where we will need it 7 days prior to check-in date.
3.4 Payment:
3.4.1 Personal cheques or American Express are not accepted.
3.5 Cancellation:
3.5.1 Refunds attract a cancellation fee of 3% on the amount pre-paid/paid at the charge of the guests.
3.5.2 The following applies to the cancellation, except during the Peak Season:
• If a reservation is cancelled on the check-in date or no-show, 100% of the total cost will be charged for every night cancelled including pre-booked services;
• If a reservation is cancelled 7 or less days prior to the reservation check-in date, 50% of the total cost will be charged for every night cancelled including pre-booked services;
• If a reservation is cancelled between the date of booking confirmation and 7 days prior to the reservation check-in date, full refund will be given.
3.5.3 The following applies to the cancellation during Peak Season:
• If a reservation is cancelled 7 or less days prior to the reservation check-in date, 100% of the total cost will be charged for every night cancelled including pre-booked services;
• If a reservation is cancelled between the date of booking confirmation and 7 days prior to the reservation check-in date, full refund will be given.
4 CANCELLATION BY US
4.1 If you do not pay the deposit or the requested amounts by the dates that they are due, or do not return a confirmation email, your reservation will not be confirmed and we will be entitled to terminate the tentative booking and retain any amounts paid to us.
5 BOND
5.1 Guests are required to provide their debit or credit card details upon booking as security in case of damages, loss (keys), smoking inside or excessive cleaning.
5.2 You agree that we are entitled to debit the debit or credit card referred to in clause 5.1 or that you provided at the date of booking confirmation for any amount which is payable by you under these Terms and Conditions including to cover any costs incurred such as the repair of any damage to the Property, missing items belonging to the Property, excessive cleaning and additional staff hours incurred as a result of your stay.
6 SERVICES
6.1 You agree that any services to be used or undertaken on the Property are to be booked and managed by our staff
6.2 Breakfast, Pack lunch and Dinner :
6.2.1 Last Light Lodge is fully licensed and BYO is not available.
6.2.2 Personal cheques or American Express are not accepted. Full payment is mandatory at the date of the booking.
6.2.3 Breakfast and Pack lunch Bookings are required at least the day before and are confirmed upon receipt of full payment and subject to our confirmation.
Cancellation a day prior are fully refund, but no refund after that.
6.2.4 Dinner Bookings are required at least 2 days before and are confirmed upon receipt of full payment and subject to our confirmation.
Cancellation 7 days or more prior are fully refund, we will keep 100% of the amount paid between 7 or less days prior.
6.2.5 Bookings on New Zealand Statutory Holidays will incur a 15% Statutory Holiday surcharge.
6.3 Events on the Property or use of the Property as a venue require our express authorization in writing and may be an additional cost.
6.4 Public access to the property is prohibited at all times and our permission is required for guests / visitors to access the Property.
7 GARDENS
7.1 You acknowledge that the Property is a permaculture garden with conservation practices undertaken on the Property. This includes sustainable farming, native bird breeding, native plantings, and predator proofing. The ecology on the Property is vulnerable and you agree to respect the Property, treat with care the animals, plants, land and structures and not to leave any rubbish or food anywhere on the Property, use the available bins.
7.2 In consideration of clause 8.1, you also agree that the Property gardens are private property and you can’t take anything from the gardens without our express authorization.
8 YOUR RESPONSIBILITIES
8.1 You may not accommodate more than the maximum number of occupants as stated in your reservation.
8.2 You are responsible for the cost of repairing any obvious damaged or missing furniture, fixtures and fittings on the Property.
8.3 You must take reasonable care of your own health and safety and must make sure that you behave in a safe manner at all times. You agree to observe any health and safety policies and procedures put in place by us at all times, and must ensure that your acts or omissions do not endanger the health and safety of any other person.
9 DEPARTURE
9.1 You shall vacate the property no later than the required departure time as notified to you by us.
9.2 Late check-out is subject to availability and could implied a cost equivalent to 50% of one night’s accommodation rate.
9.3 Accounts must be settled in full prior to departure.
10 INSURANCE/LIABILITY
10.1 Your personal effects are not insured by us. You are responsible for all personal items you bring to the Property and for any loss or damage to such items.
10.2 All facilities and any activities you participate in will be at your own risk. We do not accept any responsibility for injury or loss suffered. You will be required to sign a Registration & Waiver form upon arrival.
10.3 Children must be supervised at all times by a parent or responsible adult.
10.4 We do not and will not make any representations or give any express or implied warranties of any kind in relation to the Property.
10.5 All dietary requirements must be notified in writing. While all reasonable endeavors will be taken to ensure such dietary requirements are met, we cannot guarantee that no traces or contamination that is beyond our control will not occur.
11 DISPUTES
11.1 If a dispute arises between you and us, we will use our reasonable endeavors to obtain resolution of the dispute by discussion between all concerned parties. If that process does not result in resolution of the dispute, then the dispute may be referred by any of the parties to the New Zealand Disputes Tribunal. A dispute does not excuse any party from performing its obligations under these Terms and Conditions.
12 GENERAL
12.1 All parties agree that the laws and courts of New Zealand have exclusive jurisdiction to the arrangements between the parties and to any matter referred to in this document.
13 FORCE MAJEURE
13.1 No party will be liable for any delay or failure to perform its obligations under these Terms and Conditions if that delay or failure is caused by any event beyond its reasonable control, provided that party promptly gives written notice of fact and circumstances of that event to the other party and uses all reasonable endeavors to mitigate its effects.R
